In 1965, Brimhall, now deceased invented a hand pump hydraulic piston system.  Then in 1967 he invented a combined cab latch for semis.  He owned Brimco Hydraulics and Engineering, the defendants.  He died in 1969. After his death, Brimco got a loan from Time and defaulted on the loan. Time is now sueing that the old patent is no longer valid, because it was on sale for a year and was obvious due to its printing in a publication.  Time however, failed to produce the evidence neccessary to support the prior use claim. This applied to all claims by Time, therefore the earlier jury judgement was afffirmed and the patents are valid and upheld.
