In this case, Harman International Industries was sued by MIT for infringing upon a patent of voice recognition software for automobile navigation systems. The program was developed by MIT and no one signed a confidentiality agreement. A thesis was written on the subject by the inventor, Davis, and the thesis was public. Fortunately, the ruling was handed down that the public use bar was not violated, and that the amound of confidentiality and experimentation was enough to hold the standing. The thesis was not publicly available enough to count as published.
